1. Parties and Acceptance
This End User License Agreement ("EULA" or "Agreement") is a binding legal agreement between you ("User" or "you") and Adam Markocki, an individual sole trader based in Poland ("Developer," "we," "us," or "our").
By downloading, installing, or using BookWorm (the "Licensed Application" or "App"), you agree to be bound by these Terms. If you do not agree, do not download, install, or use the App.
You acknowledge that this EULA is between you and Adam Markocki only, and not with Apple. Apple Inc. ("Apple") is a third-party beneficiary of this EULA and, upon your acceptance, Apple will have the right to enforce this EULA against you.
2. License Grant
Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Licensed Application on Apple-branded products that you own or control, solely for your personal, non-commercial purposes and as permitted by the App Store Usage Rules.
This license does not constitute a sale of the Licensed Application or any copy thereof. The Licensed Application is licensed, not sold, to you. You may use the App on all devices signed into the same Apple Account, as permitted by the App Store Usage Rules.
3. Permitted and Prohibited Uses
Permitted
- Personal, non-commercial reading tracking — logging books, recording progress, setting goals, and managing your library.
Prohibited
- Reverse engineering, decompiling, disassembling, or attempting to derive source code;
- Sublicensing, selling, transferring, or distributing the App to third parties;
- Modifying, adapting, or creating derivative works;
- Using the App to build a competing product or service;
- Using automated scripts, bots, or scraping tools on the App or its data;
- Circumventing subscription validation, license verification, or security features;
- Using the App in violation of any applicable law or regulation.
4. BookWorm Pro Subscription
4.1 Subscription Options
BookWorm Pro is available as two auto-renewing subscription options managed entirely through Apple In-App Purchase:

4.2 Free Trial
BookWorm Pro includes a 7-day free trial for new subscribers. After the trial, your subscription automatically renews at the applicable price unless cancelled at least 24 hours before the end of the trial. Your Apple Account is charged within 24 hours prior to the end of each billing period. Any unused portion of a free trial is forfeited upon subscription purchase.
4.3 Payment and Billing
All payments are processed by Apple through the App Store. The Developer never receives, stores, or has access to your payment card information, billing address, or financial details.
4.4 Cancellation and Refunds
Cancel at any time via Settings → [your name] → Subscriptions. Refund requests must be submitted to Apple at reportaproblem.apple.com. No partial refunds for unused subscription time; access continues until the end of the billing period.
4.5 Free Tier
BookWorm is free to download. The core reading tracker is available to all users. Specific premium features require an active BookWorm Pro subscription.
4.6 EU 14-Day Withdrawal Right
For EU/EEA users: You have a statutory 14-day right of withdrawal under EU Directive 2011/83/EU. By beginning to use digital content immediately upon purchase, you expressly consent to immediate performance and acknowledge forfeiture of withdrawal rights once the digital content has been fully delivered (Article 16(m) of Directive 2011/83/EU). This does not affect your rights under Apple's refund policy.
5. Data Storage and Backup Responsibility
BookWorm stores your reading data on your device and in your personal iCloud account via Apple CloudKit (if signed in to iCloud). CloudKit uses Apple's private database — your data is not accessible to the Developer or other users.
The Export feature (Settings → Export My Data, JSON format) is provided as a convenience. We strongly recommend exporting your data regularly.
6. Third-Party Services and Disclaimers
6.1 Google Books API
Book metadata is provided by Google LLC. The Developer does not guarantee accuracy or availability. Use is subject to Google's Terms of Service.
6.2 PostHog Analytics
The App uses PostHog for anonymous analytics — no personally identifiable information is transmitted. Data processed in the EU (Frankfurt, Germany). See our Privacy Policy for full details.
6.3 Apple Services
App Store, In-App Purchases, iCloud CloudKit, and notifications are Apple services subject to Apple's terms. The Developer is not responsible for Apple service outages or iCloud storage limits.
7. Intellectual Property
The Licensed Application — including source code, design, user interface, graphics, animations, the "BookWorm" name, the worm mascot character, and all associated visual elements — is owned by Adam Markocki and protected by copyright, trademark, and other intellectual property laws of Poland, the EU, and applicable international treaties.
No rights are granted except the limited license in Section 2.
Your data belongs to you. Book lists, reading logs, notes, and profile information you create remain your property. The Developer claims no ownership over your personal reading data.
8. Maintenance, Support, and Updates
Adam Markocki is solely responsible for maintenance and support. Apple has no obligation to furnish any maintenance or support services.
Support via email: markockidev@icloud.com on a best-efforts basis. The Developer will endeavour to respond within a reasonable timeframe. Updates may be required for continued use.
9. Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
If any implied warranty cannot be excluded, such warranty is limited to 90 days from first download, or the minimum period required by law.
EU/EEA consumers: Nothing here affects your statutory rights under EU Directive 2019/770, including your right to a minimum 2-year guarantee of conformity.
In the event of failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ADAM MARKOCKI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP.
TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID IN THE PRECEDING 12 MONTHS, OR (B) EUR 10.
Nothing excludes liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; or (iii) liability that cannot be limited by applicable law.
EU/EEA consumers: Mandatory consumer protection rights under Directive 2011/83/EU are not affected.
11. Product Claims
Adam Markocki, not Apple, is responsible for addressing any claims relating to the Licensed Application, including product liability claims, claims that the App fails to conform to legal requirements, and claims under consumer protection, privacy, or data protection legislation.
12. Intellectual Property Infringement Claims
In the event of any third-party claim that the Licensed Application infringes intellectual property rights, Adam Markocki, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
13. Export Compliance
You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Poland, without regard to conflict of law provisions.
EU consumers: Mandatory consumer protection provisions of your country of habitual residence apply in accordance with Article 6 of Rome I Regulation (EC) No 593/2008. The Developer and User will attempt to resolve disputes amicably within 30 days of written notice.

15. Modification of Terms
Material changes will be communicated via in-app notice or App Store update notes at least 30 days before taking effect. The Effective Date at the top of this document will be updated. Continued use after the new effective date constitutes acceptance.
16. Termination
The Developer may terminate this license immediately if you breach any provision of these Terms, including reverse engineering, IP infringement, circumventing subscription verification, or illegal use.
Upon termination, cease all use and delete all copies from your devices.

17. Severability and Entire Agreement
If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary, and remaining provisions continue in full force.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Adam Markocki regarding the Licensed Application and supersede all prior agreements.
